THE TERMS OF USE OF THE SITE

We, hereby, kindly request that you read the following terms of use before you start using our web site.

The Terms of Use of the Site constitute an irrevocable agreement entered by and between Anka Toprak Ürünleri Sanayi ve Ticaret Anonim Şirketi. By visiting the SITE and continuing to use it, the USER shall be deemed to have accepted these Terms and Conditions.

The USER may use the SERVICES offered in the SITE only in accordance with these “Terms of Use of the Site” and solely for lawful purposes. These terms and conditions apply to all individuals who visit the SITE or want to use the SERVICES provided on the SITE.

It is deemed that the USER, who visits the web site, accepts the following terms and conditions:

1. DEFINITIONS

The following terms used in this document shall have the meaning assigned to them below.

• ANKA TOPRAK/COMPANY: Anka Toprak Ürünleri Sanayi ve Ticaret Anonim Şirketi
• SITE: The domain, https://ankaseramik.com.tr, and all sub-domains,
• SERVICE: All services provided by ANKA TOPRAK through the web site, https://ankaseramik.com.tr.
• USER: All natural or legal persons that visit/use the SITE in any manner,
• CONTENT: Any written, visual and audio material published on the SITE,
• PRODUCT: Any goods and services manufactured and launched by or on behalf of ANKA TOPRAK; all intellectual and industrial property rights are held by ANKA TOPRAK who also owns rights of use and licensing,

1. USE OF THE SITE BY PERSONS WITHOUT CONTRACTUAL CAPACITY
1. The SERVICES that are offered and delivered through the SITE may only be used by persons who are at least eighteen (18) years old. The USER, by visiting or using the SITE, declares and undertakes that the user is at least eighteen years old, has full contractual capacity (a person who is legally capable to enter into agreements, is not minor and does not have any incapacity), the agreement is read and understood, and terms and conditions of the agreement bind the user.
2. If the USER is younger than eighteen or does not have contractual capacity (persons with total incapacity or limited capacity), they are prohibited from using or visiting the SITE (and from using the SERVICES).

1. CONTENT
1. The SERVICES that are actually offered or will be offered in the web site are either the legal property of the Anka Toprak Ürünleri Sanayi ve Ticaret Anonim Şirketi under title of ANKA TOPRAK or used legally after necessary permissions are taken.
2. ANKA TOPRAK has all rights of disposal over the SITE and the SERVICES. Therefore, the CONTENT of the SITE cannot be distributed, used after amendment, and downloaded for personal or commercial aims, such as advertisement, and it cannot be re-posted or copied in social media or any similar digital/online media.

1. FORBIDDEN USAGE
1. The USER will be deemed to agree not to use the SERVICE if any one of following conditions is caused by the USER:

• Any condition that violates any local legislation and applicable international legislation,
• Abusing, harming the minors or people, who are not able to defend themselves, or attempting thereof through the SERVICES, the title of ANKA TOPRAK or any CONTENT that is published in this web site,
• Impersonating the COMPANY and attempting thereof, employees of the COMPANY, a user or any other person,
• Presence of aims or actions that are illegal in nature such as violating, threatening, deceiving or harming rights of other people,
• Any behavior that prevents or limits the use of the SERVICES by users or any other person, can harm the COMPANY or users of the SERVICE, can disturb them or leads to responsibility for them.

1. Moreover, the USER will agree not to use the SITE in presence of following conditions:

• If the SITE is used in a manner that deactivate, overload, harm or disrupt the SITE or interferes with the use of the SITE by any other party,
• Use of any automatic device/software, such as a robot, or of manual processes to copy or monitor the SITE and for other unauthorized purposes,
• Use of any device, software, and other instruments to prevent proper functioning of the SITE,
• Use of computational malicious components/tracers that contain technological malicious codes, such as virus, Trojan horse, worm, logic bomb etc.
• Unauthorized access that can damage or disrupt features in any manner by connecting to the SITE from the server, where the SERVICE is stored, or from another server or any computer or any database,
• Any action that can impair dignity and reputation of ANKA TOPRAK
• Any action that can prevent intended operation of the SERVICE.

1. INTELLECTUAL RIGHTS
1. The intellectual rights of the SERVICES that are provided on the SITE, and the CONTENTS and features (excluding the contents provided by USERS) are owned by ANKA TOPRAK and other organizations that are mentioned in the SITE; all intellectual and industrial property rights belong to ANKA TOPRAK. These SERVICES are protected pursuant to provisions of the Law on Intellectual and Artistic Works and applicable international legislation. The CONTENTS that are published in the SITE and the ANKA TOPRAK brand cannot be linked to any PRODUCT or SERVICE without explicit written approval of ANKA TOPRAK.
2. The domain name, com.tr., and all sub-domain names that are within the scope of this SITE belong to ANKA TOPRAK; all intellectual rights are owned by ANKA TOPRAK.

• Article, review, evaluation, letter and all similar written materials,
• Composition, cut, single, sound and all other audio materials,
• Drawing, picture, photography, and all other visual materials,
• Video and other visual and/or audio material,
• The design, software, codes and other software material that create this web SITE,

All written, visual or audio materials that are published and shown in the SITE, including but not limited to above written ones, are called CONTENT, and they are protected under regulations and laws on intellectual and industrial property rights.

1. All articles, reviews, evaluations, letters and other written works as well as composition, cut, sound and all other audio works, and drawing, picture, photograph and all other visual works, and video and other visual and/or audio works that are published in the SITE and are created by ANKA TOPRAK are owned by ANKA TOPRAK pursuant to the Article 8 of the Law on Intellectual and Artistic Works.
2. Following actions on all types of contents that are published in the SITE are strictly subject to explicit written approval of ANKA TOPRAK that is regarded as author and owner.

• Processing or compiling within the scope of the Article 6 of the Law on Intellectual and Artistic Works,
• Any change in the content,
• Copying, reproducing, re-publishing or distributing,
• Reading, playing, or showing in public places directly or using any device that helps transmission of mark, signal, sound or picture within the scope of the Article 24 of the Law on Intellectual and Artistic Works,
• Within the scope of the Article 25 of the Law on Intellectual and Artistic Works, broadcasting through cable and wireless broadcasting organizations, such as radio, television, satellite, and cable, or using devices that help transmission of mark, signal, sound and picture, including digital transmission, and re-broadcasting by other broadcasting organizations after broadcasted works are obtained from these organizations,
• The use of titles and spots in web sites of USERS and in virtual media,

1. The USERS agree and undertake that the CONTENTS, which are published in the SITE, are not used for any purpose mentioned in this paragraph without explicit written approval and that if they are used without explicit written approval, the USERS will compensate all pecuniary losses and intangible damages of ANKA TOPRAK – the owner of all rights. If they are used without explicit written approval, ANKA TOPRAK shall be free to take all legal actions, including execution and punishment.
2. Pursuant to provisions of the Article 7 of the Law on Intellectual and Artistic Works, publishing the contents in the SITE does not imply they are made public. All rights of the content owner, arising out of the Law on Intellectual and Artistic Works, are reserved.

1. TRADEMARKS AND COPYRIGHT
1. All PRODUCT titles that are mentioned in the SITE or published in other web sites, which can be accessed through the links that are controlled by ANKA TOPRAK, are trademarks of ANKA TOPRAK, its subsidiaries or joint ventures. ANKA TOPRAK shall have the right to take legal action pursuant to copyright provisions of the Industrial Property Law and the Law on Intellectual and Artistic works in case of unauthorized use or misuse of these trademarks.
2. ANKA TOPRAK respects intellectual rights of other persons and institutions. If you have any claim about copyright or any other intellectual property right on the CONTENTS that are published in the SITE or on the SERVICES that are delivered in the SITE, you can communicate your claim through the “Contact” page of the SITE.

1. LINK TO OTHER SITES
1. The SITE can contain links or references to some other web sites that are controlled by ANKA TOPRAK. Contents of these sites or the links they contain are supervised by ANKA TOPRAK.
2. The SITE may also contain links to third party sites that are not controlled by ANKA TOPRAK or are not owned by our company. Since ANKA TOPRAK does not have any control on these web sites, the USER agrees and commits that ANKA TOPRAK does not assume any responsibility for any positive and negative losses and damages that may arise out of contents and confidentiality policies of these web sites.

1. RESPONSIBILITIES OF USERS/DISCLAIMER OF ANKA TOPRAK
1. ANKA TOPRAK does not make any declaration or does not give guarantee, express or implied, about operation of the SITE or the information that is published in the SITE, the CONTENT or the materials.
2. Solely using or visiting the SITE cannot be deemed as establishment of a buyer/seller or a consumer/distributor relationship between the USER and ANKA TOPRAK.
3. The USER is responsible to take measures for malicious codes, such as virus, that can be uploaded from the SITE to devices of the USER.
4. ANKA TOPRAK, irrespective of the title, does not assume any responsibility for any direct and/or indirect pecuniary and/or intangible loss and positive and/or negative damages arising out of the access to the SITE and the direct and indirect use of the information that is published in the site.
5. ANKA TOPRAK or any person who is related with ANKA TOPRAK cannot guarantee faultlessness, security, safety, reliability, quality, exactness or accessibility of the SERVICES and the SITE.
6. The USERS are forbidden to upload any content, software or any other material that contains malicious components to the site by transmitting numerous queries using automatic software and sending numerous requests or information to the site with automatic and non-automatic methods. ANKA TOPRAK shall have the right to block access of the USERS, who are found to take such actions, to the site, delete the USER or take legal and penal actions about these USERS.
7. Without prejudice to the generality of the foregoing, ANKA TOPRAK or any person who is related with ANKA TOPRAK does not guarantee or commit that the SITE, the CONTENT of the SITE or the PRODUCTS, which are obtained through the SERVICES delivered by the SITE, or the SERVICES are exact, safe, error-free, and uninterrupted, and that potential defects will be corrected, the SERVICES delivered over the site or the server will be free of viruses or other malicious software, and that the SERVICES obtained through the SITE will meet expectations of the user.
8. The USER agrees and commits that information of other people or USERS shall not be collected over the SITE or shall not be used, the SITE service shall not be used for any illegal or unauthorized purpose, provisions of the Law on Intellectual and Artistic works and of relevant legislation, including but not limited to all applicable regulations, shall be strictly followed when the SITE service is used.
9. The USER shall not use communication and address details, which are written in the “Contact” page of the SITE, for any purpose other than questions, suggestions or complaints about the PRODUCTS manufactured in ANKA TOPRAK or the SERVICES; if the USER occupies the communication channels or actions of the USER are illegal, the USER shall assume necessary legal responsibility.
10. 8.10.THE USER agrees and commits that considering all communications with ANKA TOPRAK, the USER shall not disclose personal data, which is mentioned in the Personal Data Protection Law (Law No. 6698) and can be processed only if explicit consent is obtained, of the USER and/or third parties, and that if this provision is violated, ANKA TOPRAK shall not be responsible for this disclosure, and that ANKA TOPRAK shall recourse to the USER for all penalties, compensations and all other positive and negative damages secondary to violation of this provision.
11. 8.11.The personal data that is published in the SITE, such as brief curriculum vitae of the founder team, their names, titles, and contact details, is made public by the data subject “solely to introduce the founder team to USERS”; if such information is processed by USERS or third parties for any other purpose (other than the intended purpose) without explicit consent, data subjects shall be free to take necessary legal action pursuant to the Personal Data Protection Law.
12. 8.12.The SITE that is controlled and managed by ANKA TOPRAK and is updated by ANKA TOPRAK is only accessible to USERS who reside in Türkiye. ANKA TOPRAK shall not guarantee that the information, products and details, which are published in this SITE and other sites accessed through the controlled links over this SITE, are also correct outside the borders of Türkiye.

The USERS that access to this SITE over an IP address in any other country shall be responsible to follow provisions of Turkish Legislation when the SITE is used.

1. 8.13.ANKA TOPRAK can block access of the USER to the site if it finds that the terms of use are violated.

1. AMENDMENT IN SERVICE/CONTENT
1. 9.1.ANKA TOPRAK reserves the right to withdraw or amend the SERVICES or the CONTENT without any responsibility to notify the other party. ANKA TOPRAK shall not assume any responsibility for the SERVICES that are amended at any time or cannot be accessed.
2. 9.2.ANKA TOPRAK can occasionally limit the access to the SITE completely or to some pages of the SITE.

1. AMENDMENT IN THE TERMS OF USE
1. 10.1.ANKA TOPRAK can amend the “The Terms of Use of the Site” at any time, provided the amendment is published in the SITE. The amended terms of use shall be valid immediately after they are published in the site.
2. 10.2.Since the amendments in the terms of use bind the USER, the USER shall be responsible to check amendments.  If the USER continues using the SITE despite amendments in the terms of use, it implies that the USER accepts the amended terms of use, approves the amendment, and the amended terms of use bind the USER.
3. 10.3.If the USER does not accept the amendments in the terms of use, it shall not be authorized to use the SERVICE that is obtained over the SITE.

1. GOVERNING LAW
1. 11.1.The terms of use are governed by laws and legislation of the Republic of Türkiye. If it is found that any article of the terms of use is invalid or unenforceable from legal point of view, the rest articles shall be enforceable.
2. 11.2.Ankara courts, mediation and arbitration bureaus as well as execution offices shall be competent to resolve the disputes arising out of the terms of use.

1. VALIDITY

This Terms of Use of the Site, hereby, shall be valid immediately after it is published in the SITE.
